Town Planning is about people and the community and aims to maintain and improve our quality of life. Council takes a great deal of care in planning our community and, through our Local Planning Scheme, we aim to create a high-quality town and rural environment.
While all communities are made up of individuals with different tastes, needs and lifestyles, some values are common to all. One of the main functions of effective Town Planning is to ensure that development and land use proposals are appropriate for the area now and into the future.
There are a number of legislative and policy documents that provide criteria that are used to assess planning applications. Some of the most commonly used documents are:

Planning Applications
Planning applications are assessed against the requirements set out in the relevant legislation or policies. The Shire will either approve or refuse an application based on how it meets the legislative requirements.
Planning applications may be approved or refused either through delegated authority (meaning certain Shire officers can make a decision) or by Council.
Note: Council meets on a bi-monthly basis (every two months), which may impact on the length of the application processing time.
In the event that an application is not supported, the Shire will contact the applicant to advise of the issues and reasons the proposal cannot be supported and the applicant will have the opportunity to amend the proposal to address the concerns if possible.
If the concerns cannot not be addressed the application will be refused. If the refusal is issued, the applicant has a right to an appeal through the State Administrative Tribunal (SAT).
How to apply
All development/land uses require approval under the Planning and Development Act 2005 for all works or use of land, unless an exemption applies.
The types of development that may require development and/or land use approval are:
- Building envelope modifications
- Clearing of vegetation
- Home occupation
- Development in a place of landscape value
- Development located in a Bushfire Prone Area (BAL40 or BALFZ)
- Grouped dwellings (Unit sites where there is more than 2 dwellings)
- Ancillary accommodation outside of residential zones
- Advertising signs
- Commercial development or land use
- Industrial development or and use
- Extractive industries/mining
- Change of use

The Shire receives support and advice from Simon Lancaster, Shire of Chapman Valley under a resource sharing arrangement however, all enquiries are to be referred to the Shire of Mingenew in the first instance.
The documents needed for a Development Application will vary dependent on the proposed Development. As a guide, the minimum following documents will be required:
- Completed Application for Development Approval form signed by the owner of the land on which the development is located
- Copy of Certificate of Title
- Payment of required application fee (view Planning Schedule of Fees and Charges)
- Cover letter/report outlining the proposal
- Location Plan and/or Site Plan
- Scaled floor plans, elevations, sections of the proposed works.

In order to obtain planning approval a signed application form for planning consent is required to be lodged with the Shire and an Application for Planning Approval Form can be downloaded below:
